Euratom) n \u00b0 1141\/2014 du Parlement europ\u00e9en et du Conseil du 22 octobre 2014 relatif au statut et au financement des partis politiques europ\u00e9ens et des fondations politiques europ\u00e9ennes<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> (le \u00ab&nbsp;<strong>R\u00e8glement&nbsp;<\/strong>\u00bb) \u00e9tablit le cadre juridique applicable aux partis politiques europ\u00e9ens et \u00e0 leurs fondations. &nbsp;<\/p>\n\n\n\n<p>Ce dernier a cr\u00e9\u00e9 pour eux un statut juridique propre au niveau de l\u2019Union et fixe les conditions d\u2019enregistrement, de fonctionnement et de financement.<\/p>\n\n\n\n<p>En pratique, les principales r\u00e8gles \u00e0 retenir sont :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>un parti politique europ\u00e9en doit \u00eatre pr\u00e9sent dans plusieurs \u00c9tats membres et respecter les valeurs fondamentales de l\u2019UE (d\u00e9mocratie, \u00c9tat de droit, droits fondamentaux) ;<\/li>\n\n\n\n<li>l\u2019Autorit\u00e9 pour les partis politiques europ\u00e9ens et les fondations politiques europ\u00e9ennes (APPF) est charg\u00e9e de les enregistrer, de contr\u00f4ler leur conformit\u00e9 et, le cas \u00e9ch\u00e9ant, de les sanctionner ;<\/li>\n\n\n\n<li>les partis enregistr\u00e9s peuvent b\u00e9n\u00e9ficier d\u2019un financement public europ\u00e9en, sous r\u00e9serve de r\u00e8gles strictes de transparence financi\u00e8re et d\u2019interdiction de certains dons (anonymes, \u00c9tats tiers, etc.) ;<\/li>\n\n\n\n<li>en cas de violation, l\u2019Autorit\u00e9 peut prononcer des amendes, retirer les financements ou radier le parti.<\/li>\n<\/ul>\n\n\n\n<p>La Commission europ\u00e9enne, dans le cadre de son plan d\u2019action pour la d\u00e9mocratie europ\u00e9enne (2020), a lanc\u00e9 en 2021 une r\u00e9vision du R\u00e8glement sur les partis politiques europ\u00e9ens et leurs fondations.<\/p>\n\n\n\n<p><strong>Objectifs principaux de la r\u00e9forme<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Faciliter les relations entre partis europ\u00e9ens et partis nationaux.<\/li>\n\n\n\n<li>Accro\u00eetre la transparence (publicit\u00e9 politique, dons).<\/li>\n\n\n\n<li>R\u00e9duire la charge administrative.<\/li>\n\n\n\n<li>Am\u00e9liorer la viabilit\u00e9 financi\u00e8re des europartis\/fondations.<\/li>\n\n\n\n<li>Abaisser le cofinancement (10 % \u2192 5 %).<\/li>\n\n\n\n<li>Permettre de recevoir des contributions de membres situ\u00e9s hors UE.<\/li>\n\n\n\n<li>Autoriser l\u2019utilisation de fonds de l\u2019UE dans des campagnes r\u00e9f\u00e9rendaires li\u00e9es \u00e0 l\u2019UE.<\/li>\n<\/ul>\n\n\n\n<p><strong>Position du Parlement europ\u00e9en (2022)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Favorable \u00e0 plus de transparence et de stabilit\u00e9 financi\u00e8re.<\/li>\n\n\n\n<li>Souhaite rationaliser les communications entre partis europ\u00e9ens et nationaux.<\/li>\n\n\n\n<li>D\u00e9fend l\u2019\u00e9galit\u00e9 hommes-femmes (\u00e9quilibre dans les organes dirigeants, lutte contre le harc\u00e8lement).<\/li>\n\n\n\n<li>Veut garantir que les non-membres de l\u2019UE respectent les valeurs de l\u2019UE.<\/li>\n<\/ul>\n\n\n\n<p><strong>Position du Conseil (2022)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Plus restrictif : contributions limit\u00e9es aux seuls membres de l\u2019UE.<\/li>\n\n\n\n<li>Maintien du cofinancement (10 % pour les partis, 5 % pour les fondations).<\/li>\n\n\n\n<li>Obligation annuelle de d\u00e9clarer l\u2019adh\u00e9sion aux valeurs de l\u2019UE.<\/li>\n\n\n\n<li>Plafond de 2 % pour les ressources autog\u00e9n\u00e9r\u00e9es.<\/li>\n\n\n\n<li>Exclusion des campagnes r\u00e9f\u00e9rendaires.<\/li>\n\n\n\n<li>Promotion de l\u2019\u00e9galit\u00e9 des sexes sur les listes \u00e9lectorales et dans les partis.<\/li>\n<\/ul>\n\n\n\n<p><strong>N\u00e9gociations<\/strong><\/p>\n\n\n\n<p>Le 17 juin 2025<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a>, les n\u00e9gociateurs du Conseil et du Parlement sont parvenus \u00e0 un accord provisoire sur les modifications du statut et du financement des partis politiques europ\u00e9ens et des fondations politiques europ\u00e9ennes.<\/p>\n\n\n\n<p>Les n\u00e9gociateurs ont d\u00e9clar\u00e9 que les nouvelles r\u00e8gles de l\u2019UE pour les partis politiques et les fondations am\u00e9lioreront la transparence, r\u00e9duiront les formalit\u00e9s administratives et les \u00e9quiperont pour lutter plus efficacement contre l\u2019ing\u00e9rence \u00e9trang\u00e8re.<\/p>\n\n\n\n<p>Ces r\u00e8gles devraient renforcer les valeurs europ\u00e9ennes en imposant l\u2019alignement sur les principes de l\u2019UE, l\u2019\u00e9quilibre entre les sexes, les politiques de lutte contre le harc\u00e8lement et la production de rapports annuels sur les \u00e9carts de repr\u00e9sentation.<\/p>\n\n\n\n<p>Le 16 juillet 2025, la Commission des affaires constitutionnelles du Parlement europ\u00e9en a approuv\u00e9 l\u2019accord provisoire conclu lors des n\u00e9gociations interinstitutionnelles.<\/p>\n\n\n\n<p>L\u2019accord de mise \u00e0 disposition sera soumis au vote en s\u00e9ance pl\u00e9ni\u00e8re du Parlement dans les mois \u00e0 venir. Si le Parlement l\u2019approuve, le Conseil devra \u00e9galement donner son approbation avant que le r\u00e8glement modifi\u00e9 puisse entrer en vigueur.<\/p>\n\n\n\n<p>La plupart des dispositions class=\"has-text-align-center\">*<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong><u>Reform of the Legal Framework for European Political Parties: Challenges and Prospects<\/u><\/strong><\/strong><\/h2>\n\n\n\n<p>Regulation (EU, Euratom) No. 1141\/2014 of the European Parliament and of the Council of 22 October 2014 on the statute and funding of European political parties and European political foundations (the \u201c<strong>Regulation<\/strong>\u201d)<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> establishes the legal framework governing European political parties and their foundations.<\/p>\n\n\n\n<p>It grants them a distinct legal status at the EU level and sets out the conditions for registration, operation, and funding.<\/p>\n\n\n\n<p>In practice, the main rules to keep in mind are as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A European political party must be active in several Member States and respect the fundamental values of the EU (democracy, the rule of law, fundamental rights).<\/li>\n\n\n\n<li>The Authority for European Political Parties and European Political Foundations (APPF) is responsible for their registration, monitoring compliance, and, where necessary, imposing sanctions .<\/li>\n\n\n\n<li>Registered parties may receive EU public funding, subject to strict rules on financial transparency and prohibitions on certain types of donations (anonymous donors, third-country entities, etc.).<\/li>\n\n\n\n<li>In the event of a breach, the Authority may impose fines, withdraw funding, or remove a party from the register.<\/li>\n<\/ul>\n\n\n\n<p>As part of its European Democracy Action Plan (2020), the European Commission launched in 2021 a review of the Regulation on European political parties and their foundations.<\/p>\n\n\n\n<p><strong>Main Objectives of the Reform<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Facilitate cooperation between European and national political parties.<\/li>\n\n\n\n<li>Increase transparency (political advertising, donations).<\/li>\n\n\n\n<li>Reduce administrative burdens.<\/li>\n\n\n\n<li>Improve the financial sustainability of European parties and foundations.<\/li>\n\n\n\n<li>Lower the co-financing requirement (from 10% to 5%).<\/li>\n\n\n\n<li>Allow contributions from members based outside the EU.<\/li>\n\n\n\n<li>Authorise the use of EU funds for EU-related referendum campaigns.<\/li>\n<\/ul>\n\n\n\n<p><strong>Position of the European Parliament (2022)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Supports greater transparency and financial stability.<\/li>\n\n\n\n<li>Aims to streamline communication between European and national parties.<\/li>\n\n\n\n<li>Promotes gender equality (balanced leadership bodies, anti-harassment measures).<\/li>\n\n\n\n<li>Seeks to ensure that non-EU members uphold EU values.<\/li>\n<\/ul>\n\n\n\n<p><strong>Position of the Council (2022)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>More restrictive: contributions limited to EU-based members only.<\/li>\n\n\n\n<li>Maintains the co-financing rates (10% for parties, 5% for foundations).<\/li>\n\n\n\n<li>Introduces an annual obligation to declare adherence to EU values.<\/li>\n\n\n\n<li>Sets a 2% ceiling on self-generated income.<\/li>\n\n\n\n<li>Excludes referendum campaign financing.<\/li>\n\n\n\n<li>Promotes gender equality on electoral lists and within parties.<\/li>\n<\/ul>\n\n\n\n<p><strong>Negotiations<\/strong><\/p>\n\n\n\n<p>On 17 June 2025<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a>, negotiators from the Council and the Parliament reached a provisional agreement on the amendments to the statute and funding of European political parties and foundations.<\/p>\n\n\n\n<p>According to the negotiators, the new EU rules will enhance transparency, reduce administrative burdens, and better equip European parties to combat foreign interference.<\/p>\n\n\n\n<p>These rules aim to strengthen European values by enforcing alignment with EU principles, gender balance, anti-harassment policies, and annual reporting on representation gaps.<\/p>\n\n\n\n<p>On 16 July 2025, the European Parliament\u2019s Committee on Constitutional Affairs approved the provisional agreement reached during the interinstitutional negotiations.<\/p>\n\n\n\n<p>The final agreement will be submitted to the Parliament\u2019s plenary for a vote in the coming months.
