Ces documents, parfois cr\u00e9\u00e9s au niveau international, visent \u00e0 uniformiser les valeurs, les attentes comportementales, les principes d\u2019\u00e9thique ou de compliance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Toutefois, un code mal articul\u00e9 peut cr\u00e9er une confusion normative pour les travailleurs voire affaiblir la position de l\u2019employeur en cas de conflit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Voici les points essentiels \u00e0 ma\u00eetriser.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. Nature juridique du code de bonne conduite<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le code de conduite ne s\u2019analyse ni comme un contrat de travail, ni comme une convention collective de travail et ne peut remplacer le r\u00e8glement de travail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sa port\u00e9e juridique est donc strictement conditionn\u00e9e par son articulation avec les sources sup\u00e9rieures du droit social (Loi du 5 d\u00e9cembre 1968 sur les conventions collectives de travail et les commissions paritaires).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Un code de conduite pourrait \u00eatre int\u00e9gr\u00e9 directement au r\u00e8glement de travail, mais cette solution peut se r\u00e9v\u00e9ler assez peu pratique, au vu de la n\u00e9cessit\u00e9 de respect de la proc\u00e9dure de modification du r\u00e8glement de travail (Loi du 8 avril 1965 instituant les r\u00e8glements de travail, <em>M.B.<\/em>, 5 mai 1965).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le plus souvent, le Code de conduite est adopt\u00e9 sous force de politique interne. Nous conseillons dans cette hypoth\u00e8se de veiller \u00e0 ce que le document fasse l\u2019objet d\u2019une publicit\u00e9 suffisante&nbsp;: le publier sur l\u2019intranet, solliciter un accus\u00e9 de r\u00e9ception, etc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">S\u2019il implique des cons\u00e9quences relatives au bien-\u00eatre au travail (notamment psychosocial), il conviendra de solliciter la participation du CPPT (Comit\u00e9 pour la pr\u00e9vention et la protection au travail), puisque le CPPT a le droit de remettre un avis pr\u00e9alable sur toutes les propositions qui entra\u00eenent des cons\u00e9quences au niveau du bien-\u00eatre art. II.7-3.-1\u00b0 Code du bien-\u00eatre au travail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il est en outre pr\u00e9f\u00e9rable de maintenir le code de conduite comme document-cadre de valeurs et de traduire, si cela n\u2019a pas d\u00e9j\u00e0 \u00e9t\u00e9 fait, certains engagements en politiques internes sp\u00e9cifiques, respectant les textes applicables&nbsp;:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c0 titre d\u2019exemples :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Evoquer le principe de d\u00e9connexion&nbsp;? Etablir une politique de d\u00e9connexion conforme aux exigences de la loi du 3 octobre 2022 portant des dispositions diverses relatives au travail.<\/li>\n\n\n\n<li>Evoquer la flexibilit\u00e9 au travail&nbsp;? Etablir une politique de t\u00e9l\u00e9travail conforme aux exigences de la CCT n\u00b0 85 ainsi que les conventions individuelles indispensables au t\u00e9l\u00e9travail structurel<\/li>\n\n\n\n<li>Evoquer l\u2019\u00e9galit\u00e9 homme-femme&nbsp;? Mise en \u0153uvre de la directive (UE) 2023\/970 relative \u00e0 la transparence des r\u00e9mun\u00e9rations (Pay Transparency) au sein de l\u2019entreprise&nbsp;<\/li>\n\n\n\n<li>Etc.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. Exclusivit\u00e9 du r\u00e8glement de travail en mati\u00e8re disciplinaire<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il arrive qu\u2019un code de conduite vise \u00e0 cr\u00e9er de nouveaux manquements et pr\u00e9voit une \u00e9chelle de sanctions autonome.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Or, les&nbsp;sanctions disciplinaires&nbsp;ainsi que les manquements susceptibles d\u2019y donner lieu doivent \u00eatre pr\u00e9vues au r\u00e8glement de travail (article 6 de la loi du 8 avril 1965 instituant les r\u00e8glements de travail). Cette exigence vise \u00e0 garantir la pr\u00e9visibilit\u00e9 et la s\u00e9curit\u00e9 juridique des travailleurs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. Whistleblowing et l\u00e9gislation sp\u00e9cifique<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depuis l\u2019entr\u00e9e en vigueur de la loi du 28 novembre 2022 relative \u00e0 la protection des lanceurs d\u2019alerte, toute proc\u00e9dure de signalement interne pr\u00e9vue dans un code de conduite doit respecter les exigences l\u00e9gales.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si le code int\u00e8gre une proc\u00e9dure de signalement interne, il doit ainsi respecter les obligations en mati\u00e8re de canaux, d\u00e9lais, protection du lanceur d\u2019alerte, confidentialit\u00e9, etc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Attention donc aux codes de conduite internationaux qui ne respecteraient pas les sp\u00e9cificit\u00e9s belges et europ\u00e9ennes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.
