Mais attention ! Derri\u00e8re le choix d\u2019une activit\u00e9 ludique ou originale, se cache une r\u00e9alit\u00e9 juridique qu\u2019il ne faut pas n\u00e9gliger.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Responsabilit\u00e9s, s\u00e9curit\u00e9, accidents, politique d\u2019alcool\u2026 un moment sportif ou festif peut vite tourner au cauchemar si l\u2019organisation n\u2019est pas conforme aux obligations l\u00e9gales de l\u2019employeur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Avant de lancer les invitations, il est donc essentiel de vous poser les bonnes questions\u2026 et de cocher chaque case de notre <em>check-list<\/em> !<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Clarification des r\u00f4les et responsabilit\u00e9s : un incontournable<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les <em>team building<\/em> impliquent l\u2019intervention de plusieurs acteurs internes et externes, chacun ayant un r\u00f4le bien d\u00e9fini. La communication claire des responsabilit\u00e9s de chacun est donc primordiale pour \u00e9viter toute confusion \u2013 voire tout incident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les employeurs doivent notamment s\u2019interroger, conform\u00e9ment au Code du bien-\u00eatre au travail, aux contrats de travail et aux l\u00e9gislations applicables, sur :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les responsabilit\u00e9s des managers vis-\u00e0-vis de leurs \u00e9quipes<\/li>\n\n\n\n<li>Les obligations individuelles de chaque travailleur<\/li>\n\n\n\n<li>La bonne gestion des collaborateurs externes invit\u00e9s \u00e0 l\u2019\u00e9v\u00e9nement<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Une communication interne br\u00e8ve mais compl\u00e8te est vivement recommand\u00e9e.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans certains cas, l\u2019implication du conseiller en pr\u00e9vention est recommand\u00e9e (<em>team building<\/em> particuli\u00e8rement ambitieux en terme sportif, weekends \u00e0 l\u2019\u00e9tranger, etc).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Alcool et drogues : pr\u00e9venir avec intelligence<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On ne le r\u00e9p\u00e9tera jamais assez : le bien-\u00eatre au travail est une composante strat\u00e9gique de la politique RH. \u00c0 ce titre, la gestion de l\u2019alcool lors des \u00e9v\u00e9nements professionnels ne peut \u00eatre laiss\u00e9e au hasard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depuis l\u2019entr\u00e9e en vigueur de la CCT n\u00b0 100, chaque entreprise doit mettre en place une politique pr\u00e9ventive en mati\u00e8re d\u2019alcool et de drogues. Une d\u00e9claration de principe, c\u2019est bien. Une politique concr\u00e8te et adapt\u00e9e \u00e0 votre r\u00e9alit\u00e9 de terrain, c\u2019est mieux.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trop d\u2019employeurs se limitent encore \u00e0 la phase obligatoire (une d\u00e9claration d\u2019intention reprise dans le r\u00e8glement de travail), sans aller jusqu\u2019\u00e0 la mise en place de mesures pratiques. Or, en cas de probl\u00e8me lors d\u2019un team building (consommation excessive, comportement d\u00e9plac\u00e9, accident), une politique bien pens\u00e9e peut faire toute la diff\u00e9rence : gestion de crise, encadrement adapt\u00e9, sanctions proportionn\u00e9es, etc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>R\u00e8glement de travail : \u00eates-vous vraiment \u00e0 jour ?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Votre r\u00e8glement de travail contient-il les mentions n\u00e9cessaires concernant :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les comportements prohib\u00e9s (violence, harc\u00e8lement, discrimination, etc.) ?<\/li>\n\n\n\n<li>Les sanctions disciplinaires possibles&nbsp;?<\/li>\n\n\n\n<li>Les obligations de s\u00e9curit\u00e9 g\u00e9n\u00e9rale impos\u00e9es \u00e0 tous les travailleurs ?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Un oubli ou une formulation trop vague peut vous exposer \u00e0 des responsabilit\u00e9s importantes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mieux vaut donc v\u00e9rifier en amont.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Avez-vous pens\u00e9 \u00e0 l\u2019inclusivit\u00e9&nbsp;?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il est conseill\u00e9 \u00e0 l\u2019employeur de veiller \u00e0 ce que chaque collaborateur puisse participer dans des conditions \u00e9quitables, quelles que soient ses capacit\u00e9s physiques, sa situation personnelle ou ses besoins sp\u00e9cifiques.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cela implique, par exemple :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De s\u2019assurer que le lieu de l\u2019\u00e9v\u00e9nement est accessible \u00e0 tous, en ce compris les collaborateurs dont la mobilit\u00e9 est r\u00e9duite&nbsp;;<\/li>\n\n\n\n<li>De pr\u00e9voir des alternatives ou des am\u00e9nagements pour les travailleurs en situation de handicap ;<\/li>\n\n\n\n<li>De tenir compte des contraintes physiques li\u00e9es \u00e0 une travailleuse enceinte ou en retour de cong\u00e9 maternit\u00e9&nbsp;;&nbsp;<\/li>\n\n\n\n<li>D\u2019adapter, si n\u00e9cessaire, le programme pour \u00e9viter toute exclusion\/discrimination, directe ou indirecte.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Et en cas d\u2019accident du travail&nbsp;?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Un accident survenu lors d&#8217;un team building&nbsp;peut \u00eatre reconnu comme un accident du travail, et emporter l\u2019obligation pour l\u2019employeur d\u2019agir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On rappelle les indispensables&nbsp;:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>S\u2019affilier aupr\u00e8s d\u2019une assurance accident du travail\u00a0;<\/li>\n\n\n\n<li>En cas d\u2019accident, d\u00e9clarer l&#8217;accident \u00e0 l\u2019assurance dans les 8 jours \u00e0 compter du lendemain de l&#8217;accident.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\">*<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019\u00e9quipe de <strong>moov.law<\/strong> peut vous accompagner dans la v\u00e9rification et l\u2019actualisation des documents vis\u00e9s ci-dessus.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vous souhaitez en discuter ?
